INTRODUCTION These Terms of Service ("Terms") govern your access to and use of hosting and related services provided by BlazeFrost (Pty) Ltd ("BlazeFrost", "we", "us", "our"). By accessing or using our services, you agree to be legally bound by these Terms in accordance with the laws of the Republic of South Africa. If you do not agree, you may not use our services. 2. SERVICES PROVIDED BlazeFrost provides: Shared Web Hosting Game Server Hosting VPS / Dedicated Infrastructure (if applicable) Domain-related services (if applicable) All services are subject to availability and technical feasibility. We reserve the right to modify, suspend, or discontinue services at any time with reasonable notice. 4. ELIGIBILITY You must: Be at least 18 years old, or Have consent from a legal guardian You warrant that all information provided is accurate and complete. 5. PAYMENT TERMS 5.1 Billing Services are prepaid unless otherwise agreed. Invoices must be paid before service activation or renewal. Failure to pay may result in suspension or termination. 5.2 Late Payments BlazeFrost may: Suspend services without notice Charge interest in accordance with the National Credit Act (if applicable) Recover collection costs on an attorney-and-client scale 5.3 Refund Policy (CPA Compliance) Digital hosting services are deemed to begin immediately upon activation. By activating services, you acknowledge waiver of the 7-day cooling-off period under Section 44 of ECTA where performance has begun. Refunds are granted solely at BlazeFrost’s discretion unless otherwise required by law. 6. ACCEPTABLE USE POLICY (AUP) You may NOT use our services to: Distribute malware, phishing content, or engage in hacking Host illegal content under South African law Infringe intellectual property rights Distribute child exploitation material Conduct DDoS attacks or abuse network resources Send spam or unsolicited bulk emails Host extremist or unlawful hate content BlazeFrost reserves the right to suspend services immediately for violations. 7. RESOURCE USAGE Customers may not: Abuse CPU, RAM, bandwidth, or storage Run crypto-mining software unless explicitly allowed Run services that materially degrade shared server performance We may throttle, suspend, or require upgrades where abuse is detected. 8. DATA PROTECTION (POPIA COMPLIANCE) BlazeFrost processes personal information in accordance with the Protection of Personal Information Act (POPIA). We: Collect only necessary personal information Implement reasonable technical and organisational safeguards Do not sell personal information Retain data only as long as necessary Customers are responsible for ensuring their hosted content complies with POPIA if they process personal data. Refer to our Privacy Policy for full details. 9. BACKUPS Unless explicitly included in your package: Customers are solely responsible for maintaining backups. BlazeFrost is not liable for data loss. Where backups are provided, they are courtesy services and not guaranteed. 10. SERVICE AVAILABILITY We aim for high uptime but do not guarantee uninterrupted service. BlazeFrost shall not be liable for: Network failures outside our control Force majeure events Third-party infrastructure failures DDoS attacks Power outages 11. LIMITATION OF LIABILITY To the maximum extent permitted under South African law: BlazeFrost shall not be liable for indirect, consequential, special, or economic damages. Our total liability shall not exceed the amount paid by you in the preceding 3 months. Nothing excludes liability where prohibited under the Consumer Protection Act. 12. INDEMNITY You agree to indemnify and hold BlazeFrost harmless from: Claims arising from your hosted content Violations of law Intellectual property disputes Damages caused to third parties through your services 13. SUSPENSION AND TERMINATION We may suspend or terminate services: For breach of these Terms For illegal activity For non-payment If required by law enforcement Termination does not waive outstanding payment obligations. 14. INTELLECTUAL PROPERTY BlazeFrost retains all rights in: Branding Website content Infrastructure systems Software and configurations Customers retain ownership of their hosted content. 15. FORCE MAJEURE BlazeFrost is not liable for failure to perform due to events beyond reasonable control, including but not limited to: Natural disasters Power failures Civil unrest Government actions 16. DISPUTE RESOLUTION These Terms are governed by the laws of the Republic of South Africa. Any dispute shall be: Attempted to be resolved amicably. Failing resolution, referred to mediation. If unresolved, subject to the jurisdiction of South African courts. 17. AMENDMENTS BlazeFrost reserves the right to amend these Terms at any time. Updated versions will be published on www.blazefrost.xyz . Continued use of services constitutes acceptance. 18. SEVERABILITY If any provision is deemed invalid, the remainder shall remain in full force. 19. ENTIRE AGREEMENT These Terms constitute the entire agreement between BlazeFrost and the customer.
